NEUBRANDENBOURG, Germany - Hubert Zafke, ancient male nurse of 95-year-old Auschwitz, in post during the arrival of the convoy of Ann Frank, was away on Monday at the opening of his trial in Germany which was suspended because of a disagreement on the health of the defendant.
Audience opened at about 9 h GMT in the absence of Hubert Zafke, facing a room of a hundred of places reserved for half for the press, and surrounded by a dozen cameras, determined a journalist of the AFP.
Mr Zafke was examined on Sunday by a doctor, who «mentioned suicidal thoughts, a reaction of stress and of hypertension», concluding that he « "in a fit state" to be transported nor judged of, explained straightaway the presiding judge, Klaus Kabisch.
Plaintiffs, which reported before even trial not enough eagerness of the court to be judged Mr Zafke, and had asked beside the Office of Public Prosecutor for the challenge of the magistrates, immediately claimed a medical second opinion.
Audience was suspended, after sarcastic and tense exchanges between plaintiffs and president, until the court discusses this request.
The medical aptitude of the defendant to be judged is the big unknown of this trial, the court having concluded at first in his inability before being contradicted in call.
This ancient SS must answer for complicity in the extermination of at least 3.681 men, women and Jewish children gased from their arrival in the emblematic camp of Shoah, between August 15th and September 14th, 1944.
He incurs in this title three - fifteen years of imprisonment, a principally symbolic threat seen his age.
«This trial shows that justice sometimes needs of a lot of time to find its way», estimated to the AFP CHRISTOPH HEUBNER, executive vice-president of the international Committee of Auschwitz, before the court.
«I wait that the defendant expresses himself as much as he can make him and that he breaks the silence which he noticed during all his life», he concluded.
Hubert Zafke is ancient second SS to appear this year in Germany, after the ancient security guard of Auschwitz Reinhold Hanning, judged since February 11th in Detmold (west), and before another ex-sentry of the same camp, Ernst Tremmel, 93 years old, judged from April 13th in Hanau (west).
A télégraphiste ancient of Auschwitz, Helma Kisser, 92 years old, was also censured at the end of 2015, but the keeping of a trial remains conditioned in the valuation of its state of health.
